A human Rights justification is when:

A public actor use positivist human rights (treaty law) to defend its decision and actions.

Leading to:

Turns a regime of compliance, set to protect the rights of the individual against the interest of the State, into an instrument of governance in the possession of the State.

The Problem is:

Human rights regimes themselves are not developed to regulate the switch from a regime of compliance to an instrument of governance.
